Terms of Service

These Terms of Service ("Terms") govern your use of EstimateReview (the "Service") provided by Hail & Gale LLC ("we," "us," or "the service provider"). By creating an account or using the Service you agree to these Terms.

1. The Service

The Service provides automated, AI-assisted analysis of property insurance estimates and generates informational reports. The Service is not a licensed public adjuster, independent adjuster, contractor, engineer, appraiser, or attorney, and does not provide legal, adjusting, engineering, or professional advice. Reports may contain errors or omissions, and code-related observations are general and must be confirmed with the authority having jurisdiction.

2. Accounts and security

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. We strongly recommend enabling multi-factor authentication. Firm accounts are responsible for their authorized users.

3. Your content

You retain ownership of documents you upload ("Your Content"). You represent that you have the right to upload Your Content and to permit us to process it to provide the Service, including any personal or property information about third parties it contains. You grant us a limited license to host, process, and analyze Your Content solely to provide the Service to you. We do not sell Your Content or use it to train public AI models. Your Content is deleted according to our Privacy Policy (currently after 60 days, or sooner when you delete it).

4. Acceptable use

You will not upload malware or unlawful content; upload documents you have no right to share; attempt to access other users' data; probe, scan, or overload the Service; reverse engineer the Service; or use reports to misrepresent facts to any insurer, insured, or tribunal.

5. Your acknowledgment

Before each review you must confirm: "I understand that this is an AI-assisted review only and not a professional opinion from a licensed adjuster, contractor, or attorney. I will independently verify all findings before relying on them. I agree that the service provider is not liable for any claim outcomes, payment disputes, or business decisions made based on this report." You are solely responsible for decisions you make using any report.

6. Fees, credits, and refunds

Reviews are purchased per review or with prepaid credits; firm subscriptions renew automatically until canceled. Prices are shown at checkout and processed by Stripe. Credits are non-transferable and expire 12 months after purchase unless otherwise stated. Except where required by law, fees are non-refundable; if a review fails to process due to a system error, the credit is restored. The free sample is limited and watermarked.

7. Disclaimer of warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

8. Limitation of liability

The service is provided for informational purposes only. To the maximum extent permitted by law, the service provider shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to use of the service, including but not limited to claim denials, negotiation outcomes, lost profits, or business interruption.

Liability, if any, is limited to the amount you paid for the specific review giving rise to the claim.

With respect to data security: while we implement commercially reasonable safeguards (encryption, access controls, and limited retention), no method of electronic storage or transmission is 100% secure. To the maximum extent permitted by law, the service provider is not liable for unauthorized access, data incidents, or disclosures that occur despite these safeguards, except in cases of gross negligence or willful misconduct.

9. Indemnification

You will indemnify and hold harmless the service provider from claims arising out of Your Content, your violation of these Terms, or your use of any report.

10. Termination

You may delete your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms. Sections 7–12 survive termination.

11. Governing law and disputes

These Terms are governed by the laws of Pennsylvania, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Allegheny County, Pennsylvania, unless the parties agree to arbitration.

12. Changes and contact
